These Terms & Conditions set forth the legal terms that apply to your use of the https://kapsul.tokyo website (the "Site").

Before placing your order please read these Terms & Conditions carefully and make sure you understand them, you declare to have read and accepted these Terms & Conditions. The validation of your order is therefore acceptance of these Terms & Conditions.

1. About the company

When you purchase products through the Site, you are purchasing from third party resellers (the "Partner(s)") whose names are listed on the Site. The Partner(s) concerned authorize us to enter into the contract in our name but on their behalf and to subcontract, as anonymous agents/commissioners on behalf of such Partner(s), to one of our affiliates who may then enter into the contract in their name but on behalf of the Partner(s), as principals.

Order requests submitted through Vinodici are not fulfilled by Vinodici. Vinodici does not sell alcoholic beverages. Vinodici has partnered with several authorized third party vendors ("Vendors") who sell alcohol through the Vinodici site. Prior to the final submission of your order request, Vinodici identifies the specific Vendor to whom your order request will be submitted. The vendor identified by Vinodici will be the sole party responsible for selling alcoholic beverages to you. Each vendor is responsible for compliance with all applicable laws and regulations.

2. Protection of minors

The sale of alcohol to minors is prohibited, the creation of account and the order on VINODICI are reserved for adults.

3. The products

We strive to be as accurate as possible in describing products. However, as these descriptions are based on information provided to us by VINODICI Partners, we cannot guarantee that they are completely accurate, complete, reliable or without any errors. VINODICI cannot be held responsible for the accuracy, truthfulness, reliability of the information provided by the Partners.

We do not authorize VINODICI Partners to offer products of lesser quality than the descriptions or equivalent sales standards on the Site.

The customer has the opportunity, before any order, to contact customer service to ask any questions about the product.

Unless otherwise specified, all prices are quoted in your local currency and are exclusive of taxes, customs and shipping costs. A detailed invoice is sent to you after each order, by email.

Although we try to ensure that all information, descriptions and prices on the Site are correct, errors may occur because the information is provided to us by VIVINO Partners. If we become aware of an error in the price of products you have ordered, we will promptly notify you on behalf of the VIVINO Partner and give you the opportunity to either reconfirm your order at the new price or cancel it. If we cannot reach you, your order will be treated as cancelled. If you cancel and have already paid for the products, you will receive a full refund.

Depending on your shipping address, different tax rules and other charges may apply. If you have products shipped from a VIVINO Partner outside of your territory, you may be required to pay import duties when you receive your products. We will tell you during the ordering process if customs duties are included or you will have to pay them when you receive your products. If they are not included, neither we nor VIVINO Partners can control these charges and we cannot predict their amount. You will be responsible for paying any such taxes and duties not included.

Please note that in the event that you return a product, you will be responsible for reclaiming them from your local customs office.

4. Orders and payment

When you place an order, we perform a standard pre-authorization of your payment card on behalf of and for the account of the relevant VIVINO Partners. Products will only be shipped once this pre-authorization verification has been completed.

Once we have verified your payment details and the VIVINO Partner has accepted and validated your delivery request, we will send you an email to inform you.

In the unlikely event that we or the VIVINO Partner encounter a problem in processing your order, we will send you an email explaining the problem and possibly requesting additional information in order to try to resolve the issue.

We reserve the right not to submit your order to VIVINO Partners, and VIVINO Partners reserve the right not to accept your order if, for example, the product ordered is out of stock, has been withdrawn or is otherwise unavailable, or if we do not obtain authorization for your payment or if you do not meet the eligibility criteria.

5. Delivery

The expected delivery date of the products will be specified in your order confirmation.

We will try to ensure that your order is delivered on that date but in some circumstances delivery may be delayed due to events beyond our reasonable control. In this case, we will try to have your products delivered as quickly as possible, but we cannot be held responsible for any loss resulting from such delay.

In the event of an incomplete or erroneous delivery address, requiring our carrier to return the product(s) ordered, any additional costs incurred as a result of such failure or error shall be borne in full by the end customer.

Packages are delivered according to the carrier's terms and conditions of delivery. The carrier is responsible for the goods once they have been taken in charge by him. In any case an incident occurred during transport could not be attributable to VINODICI.

According to the nature of the goods and the quantities ordered, VINODICI reserves the right to select a different carrier, subject to communicate beforehand the general conditions of transport of the products delivered or ordered. In the latter case, the customer will have the opportunity to cancel the order and obtain a refund, within 30 days, the price paid.

In the event that the package is damaged during transport, the customer must report this to the carrier upon receipt of the package. The customer is therefore required to check the contents of the package in the presence of the carrier, in order to issue a reserve in case of non-conforming contents or deterioration. Any parcel accepted without a reservation prevents a later claim. The reservation must be descriptive (e.g.: a missing bottle) and cannot contain "subject to opening the box".

6. Return

For all purchases made on the site from sellers, you have a right of withdrawal and return of products, which is to exercise with VINODICI and will inform the sellers.

Non-conformity of the ordered products, Error in the content of the order:

Any request for return of a product based on "error" must be the subject of a request for return addressed to the customer service, within a maximum of 14 days from the date of receipt of the product by the customer. When initiating a return procedure, we invite the customer to provide us with a precise written description, along with a copy of the invoice.

Products that have been subject to an "error" in the preparation of the order will be replaced by identical products or, if not available, will be refunded.

The cost of returning products due to an error will be charged to the seller. It is the responsibility of the customer who returns a product in error to provide proof of the return of the goods by himself. This proof will be made either by the presentation of a receipt of sending by registered mail, or by the presentation of a document given by a carrier to whom the routing of the returned product will have been entrusted. No other method of proof will be accepted.

Non-conformity of the ordered products, defective products:

Any request for exchange based on the "defective" character of a product will have to be the subject of a request for return addressed to the customer service, within a maximum period of 6 clear months as from the date of reception of the product by the customer. When initiating a return procedure, we invite the customer to send us a precise written description, complete with photos of the defect(s) affecting the product received.

Products deemed or identified as defective by the end customer will be replaced by identical products or, if not available, will be refunded. However, the finality of an acceptance of exchange and / or refund is subject to the examination of the defective product by VINODICI or by the seller of the product. Thus, if after investigation of our services, it turns out that the failure of the product results from an inappropriate use of it, a bad handling or a modification of the initial characteristics of the product at the initiative of its final purchaser, then the product will be neither exchanged nor refunded and will not give the right to any compensation. VINODICI reserves the right to reconsider its decision to accept an exchange, a credit note or a refund if it turns out that the description of the defect made by the customer does not correspond to its findings or if the failure of the product is attributable to the end user.

The customer has the right to refuse the exchange of a defective product by an identical product. In this case, VINODICI will make a refund of an amount equal to the purchase price including shipping costs initially paid at the time of the order.

In the case where a defective product can not be replaced by an identical product or a quality and price equivalent, VINODICI will make a refund of an amount equal to the purchase price including shipping costs initially paid when ordering.

The defective products following a return procedure must be returned in their original packaging, accompanied by the defective or damaged parts and a legible copy of the invoice. Upon receipt, VINODICI may make the necessary checks in case of doubt on the conformity of the returned products with the invoice attached and the return number.

The expenses of return for defective product will be in charge of the salesman and will be refunded to the customer by the salesman on presentation of the corresponding document after reception and checking. It is the responsibility of the customer who returns a defective product to provide proof of the return of the goods by himself. This proof will be made either by the presentation of a receipt of sending by registered mail, or by the presentation of a document given by a carrier to whom the routing of the returned product will have been entrusted. No other method of proof will be accepted.

In the absence of compliance with this procedure for return and inconsistency between the request and the conditions for reimbursement, credit or replacement of product, it will be given no action on this request, VINODICI disclaiming any responsibility in this regard.
